Eli Lilly agreed yesterday to pay up to $500 million to settle 18,000 lawsuits from people who claimed they had developed diabetes or other diseases after taking Zyprexa, Lilly's drug for schizophrenia and bipolar disorder.
Including earlier settlements over Zyprexa, Lilly has now agreed to pay at least $1.2 billion to 28,500 people who said they were injured by the drug. At least 1,200 suits are still pending, the company said. About 20 million people worldwide have taken Zyprexa since its introduction in 1996.
The settlement covers cases filed in state and federal courts by law firms or groups of firms for 18,000 clients, Lilly said. The federal suits have been overseen in Brooklyn by Judge Jack B. Weinstein of the Eastern District of New York.
The settlement will not affect continuing civil or criminal investigations of Zyprexa by state attorneys general and federal prosecutors.
Both Lilly and lawyers for plaintiffs said they were pleased with the agreement. With global sales of roughly $4.2 billion last year, Zyprexa is Lilly's largest-selling drug and a major contributor to the company's profits. Lilly shares were relatively flat after the settlement announcement. They rose 11 cents yesterday, to $52.36.
Zyprexa is the brand name for olanzapine, a potent chemical that binds to receptors in the brain to reduce psychotic hallucinations and delusions. Clinical trials show that in many patients, Zyprexa also causes severe weight gain and increases in cholesterol and blood sugar.
Documents provided to The New York Times last month by a lawyer who represents mentally ill patients show that Lilly played down the risks of Zyprexa to doctors as the drug's sales soared after its introduction in 1996. The internal documents show that in Lilly's clinical trials, 16 percent of people taking Zyprexa gained more than 66 pounds after a year on the drug, a far higher figure than the company disclosed to doctors.
The documents also show that Lilly marketed the drug as appropriate for patients who did not meet accepted diagnoses of schizophrenia or bipolar disorder, Zyprexa's only approved uses. By law, drug makers may promote their drugs only for diseases for which the Food and Drug Administration has found the medicines to be safe and effective, though doctors may prescribe drugs in any way they see fit.
In response to questions about the information in the documents, Lilly has denied any wrongdoing and said it provided all relevant information to doctors and the F.D.A. Lilly has also said it did not promote Zyprexa for conditions other than schizophrenia or bipolar disorder.
In 2004, a panel of the American Diabetes Association found that Zyprexa caused diabetes more than other widely used antipsychotic drugs, in part because it tends to cause much more weight gain. But the F.D.A. has never made a similar finding. Instead, the F.D.A. added a warning in 2003 to the label of Zyprexa and other new antipsychotic drugs about their tendency to cause high blood sugar.
In 2005, a $700 million agreement covered 8,000 patients, and the company has made 2,500 individual settlements whose total value has not been disclosed, Lilly said. The 2005 settlement valued claims at about $90,000 a plaintiff, while yesterday's agreement values claims at about $27,000 a plaintiff, at most.
The lower value for the new claims comes in part because of the F.D.A. label change, which has allowed Lilly to say that it adequately warned doctors of the risks of Zyprexa after 2003. The label change may also help to protect Lilly from future lawsuits, analysts and lawyers say.
In its statement, Lilly said the settlement did not change its view that Zyprexa is a safe and effective treatment for mental illness.
''We wanted to reduce significant uncertainties involved in litigating such complex cases,'' Sidney Taurel, Lilly's chief executive, said in the statement.
Richard Meadow, one of the lead lawyers for the plaintiffs, said the deal was fair to both sides. ''Prolonging this litigation further is in no one's best interest,'' he said.

Following massive demonstrations and a wave of student occupations against Israels war in Gaza, British activists will be hosting a speaker tour with Tamar Katz, one of the Shministim, Israeli high school students jailed for refusing to fight in the occupied Palestinian territories. She is being brought over by Workers Liberty students, but the meetings are being hosted by a variety of organisations.
Tamar, 19, was jailed three times, for a total of 51 days at the end of 2008, for refusing to take part in military service. She explained why:
I refuse to enlist in the Israeli military on conscientious grounds. I am not willing to become part of an occupying army, that has been an invader of foreign lands for decades, which perpetuates a racist regime of robbery in these lands, tyrannizes civilians and makes life difficult for millions under a false pretext of security.
I oppose the anti-Palestinian policy of attrition and the oppression, not because I prefer the Palestinian society to the Israeli one, but out of an understanding that this policy has led us down a dead-end road politically and to immorality, forced especially on soldiers stationed in the Occupied Territories. I am not willing to become one of those holding the gun pointed indiscriminately at Palestinian civilians, and I do not believe that such actions could bring any change except ever more antagonism and violence in our region.
This is an excellent opportunity for student and trade union activists who opposed the war in Gaza to learn more about the other Israel Israeli anti-war activists, students and workers who desperately need our support and solidarity.
Tamar will be speaking at universities across the UK, as well as to some trade union meetings, including the rail union RMTs London Transport Region, which is sponsoring the tour.

It is warm and sunny in Jaffa , a fishing harbour on the Eastern
Mediterranean just south of Tel Aviv; the skies are blue and the sea
rather calm, with the clientele of sidewalk cafés enjoying their
milky arak and coriander-laced coffee. The economic crisis never
arrived here; there are few lay-offs, prices have remained high,
though the shopping frenzy has somewhat subsided. A steady stream of tourists from overseas reassures us that Israel is not the only island of calm in a troubled world. However, the newspapers compete with one another's economic horror stories. They say that sales of vintage French champagne in Kazakhstan are down. "Sales of Porsche and Mercedes cars have fallen by half so far this year. People are
just going to have to get used to buying fewer Louis Vuitton bags",
bewail American salesmen. Jeez, this is a real calamity, calling for
emergency measures!
I read Tom Friedman's column in the NY Times, asking young Americans who normally crowd restaurants to stay home, eat tuna fish and be afraid, very much afraid but they do not heed his warnings. Well, the old boy has cried wolf too often. He tries to scare us, but I do not get scared, as Leo Tolstoy once said about a fellow writer. The great Western propaganda machine has run too many scares for us to care. Do you remember Iraqi WMD, evil al-Qaeda, world terror, Peak Oil, global warming, mad cow disease, bird flu? Do you know personally of even one person who suffered because of any of it?
Or look further back, into the great AIDS scare of 1990. Then, AIDS was supposed to destroy the world as we know it and kill billions;
but actually it caused just a few casualties within the gay
communities. Yes, condom manufacturers and the Big Pharma made a fortune and professional guilt-trippers accused us of being not-sufficiently-compassionate with the sufferers, but otherwise, it was just a scare. Now they want to scare us into eating tuna fish
sandwiches.
This is not to say that they can't succeed. If one shouts `Fire!' in
a crowded cinema, the results could be tragic even if there is no
fire. And there are reasons why things happen this way.
The usual explanations refer to bankers being stupid. They did not
know what they were doing when they flooded the markets with their cheap credit, or sold swaps or marketed derivatives. Alternatively, it is argued that they were so greedy that did not understand their long-term interests and ruined everything. But the bankers and the
financial elite are not stupid, neither are they short-sighted. I
believe that things happen because people intend them to happen,
unless there are very strong proofs to the contrary. I believe that unless we do something pretty drastic, they will emerge out of this
crisis even more rich, more powerful and in fuller control of our
lives.
A similar development took place in ancient Egypt , we are told.
There were some years of prosperity, and the clever guys hoarded the stuff; afterwards, some years of scarcity duly followed, and the ordinary folk ended up being indebted and enslaved to the clever
guys.
You probably recognise this as the story of Joseph and the Pharaoh
(Genesis 41). The Pharaoh had a dream of seven nice fat cows coming out of the Nile and feeding in a meadow. And suddenly, seven other, ugly and lean cows came up after them out of the river. "And the ugly lean kine did eat up the seven nice fat kine", saith the Writ. So Pharaoh awoke and asked for Joseph's advice; and he advised him to hoard the harvests up until the days of scarcity, when the collected harvests could be used not just to feed the people, but to enslave the people. And so it worked: all the people of Egypt became slaves of the Pharaoh, thanks to the clever advice of Joseph. For this reason, the people of Egypt bore a serious grudge against Joseph and his tribe of financial advisers.
History is always repeating itself. Latter-day financial advisers
have used the archetypal model of Joseph in the Bible, but they went
it one better: Instead of enjoying prosperity and being prepared for
scarcity, they orchestrated both. First, they opened the gates of
credit and got a lot of people hooked. Afterwards, they shut the
gates and ushered in their Armageddon weapon, the seven lean kine.
The bottom line remains the same as of old: they intend to enslave
America and the world.
Our like-minded friends on the Web (Mike Whitney) condemn technical
tools swaps, derivatives, ABS, MBS, CDO, CLO and other
abbreviations. They get into the technicalities, how this device
worked, how they convinced others, how they dumped and securitised the toxic debts. The "how?" part can be entertaining, but the "why?" should interest us more. If we deal with a burglar, we do not waste much time on discussion of his tools of crime, we look at the crime itself.
What did they plan to do? At Stage One, they turned the US into a
great money-sucking device, a vacuum-cleaner for the world's assets.
They printed paper dollars, issued worthless bonds, generated
trillions of debts. Income from Russian gas, Arab oil, Chinese
labour, Japanese innovations, African ore, Swedish cars and French wine was trapped in this black hole. Michael Khazin, the Russian economist, explained that these criminals acted like any professional bankrupt: they got into debt, and then they took their money and stepped out while leaving debts for the public to handle. They succeeded in putting a lot of Americans and Brits into debt, and with these debt-promissory notes they swindled the rest of the world.
At Stage Two, they fleeced the ordinary Americans who had been quite happy to participate in the grand larceny of Stage One. Their
bankruptcy does not hurt them a tiny wee bit. You do not have to be a Jew to use Jewish tactics, and the American bankers Jewish and non-
Jewish alike - took a leaf from traditional Jewish scam book and
applied it on an unheard-off scale. And among these scams, bankruptcy was one of the most popular. Enron was a first try; the idea was a very successful one: you take a public commodity and steal it; eventually people will have to buy you out.
If their plan is completed, the ordinary people of the US will find
themselves deep in debt, while the profits will go to a happy few.
Their plans to "save the economy" are just follow-up for what they
did earlier. A few guys make millions, salt their fortune away, and then ask the people to foot the bill, for otherwise, (God help us!)
there will be massive layoffs among the PR companies who advertise for champagne in Kazakhstan. The remedy is also the same as it was of old. The people of Egypt could answer Pharaoh and his financial adviser Joseph: the collected harvests are ours, thank you for temporary storage, now please move away. Do not even dream that we shall indebt ourselves and our children in order to get what is ours by right.
Likewise, Americans may answer austerity planners, including Tom
Friedman: you made money, now you pay back. You promoted the plan, now you foot the bill. You planned to confiscate our assets, now we shall confiscate yours. Take over private and personal assets of the fat cats, cancel their accounts, sell their houses and tangible
assets. Make every person who was employed in a bank fully
responsible for their bank's failure. Lynch Goldman Sachs. Forbid
bankruptcy. Try those responsible for the crash: they knew it is
coming, they planned for it. It is not by chance that architect of
the collapse Alan Greenspan swore his oath of Federal office on the
Talmud in front of Ayn Rand, Satanist and creator of the Enlightened Selfishness cult. ( Rand 's Atlas Shrugged reads like a novelization of Mein Kampf by Barbara Cartland, quipped our friend Ian Williams.)
And Greenspan has been rightly described by Stephen Lendman as Public
Enemy No 1.
This economic crisis provides us with some important lessons: World
economy has been run for the last twenty years (and made a lot of
progress) using no "real money", just inherently worthless IOUs of
paper dollars, promissory notes and bonds. The money we use
is "monopoly money", play money and it still works! We should
demystify money, understand that it has no real substance, that it is just a provisional device that may help accountants, and serve as measure of investments, but not the final measure of everything. The world can take the next step, and switch to issuance of some future zero-interest free-credit money, which will not enrich one group of people at the expense of another. Such money was used in Soviet Russia with great success, until the party nomenclature swapped it for the US dollars, reaping immense profits for themselves and leaving the rest of the public penniless. Now, the US nomenclature has decided to use the example of the Russian oligarchs and rip off the US public. But we may use the new knowledge: market model had "won" its competition against the socialist model only because of fraudulent banksters.
Do not panic, because that is what Friedman and Greenspan want you to do. Panic is a bad adviser. The crisis is imaginary: machines still
work; the people still know how to do their jobs. The sharks will eat
each other, but the small fish will escape the net. The Americans had
a lot of good, if borrowed, time. Though a lot of it was stolen or
wasted, some of the debts funded real improvements. Outside of the
Anglo-American Neoliberal core, the economy is sound. A cooling-off
period would not be too bad for the planet. Some job restructuring is
called for after the crisis, there will be less need for brokers
and more need for menders. And as for the debts, there is a solution:
instead of robbing the public, expropriate the expropriators rob the robbers!

MANY PEOPLE around the world believe in the anti-Semitic myth that we Jews are immensely clever and that all our actions prove our diabolical cunning. It is too late to turn the wheel back. Hamas is now a part of reality. It is in the Israeli interest that a Palestinian unity government be set up, a government with which we can reach an agreement that will be kept. If we have already played such a pivotal role in turning Hamas into a central Palestinian power, by all means let's talk with them!
This way we can also free Gilad Shalit in a prisoner exchange - before his 1000th day in captivity.

A lot of religions are faith based. I got surprised when I found out that one was not. Buddhism claims to be logical. Buddha even went to an extent to show how logical he was by instructing the kalamas with what is known now as the Kalama Sutta (http://en.wikipedia.org/wiki/Kalama_Sutra).

I find the writing, very nice, concise and direct to the point, something I frankly woulndt expect from a religion. Buddhism though did not stop at rationalization, how then would buddha be able to explain his views on the afterlife and even his previous reincarnations. Although the public was urged to test ideas given by faith with logic, it seemed that the more enlightened ones would acquire knowledge from still other sources.
Different people have different ways of getting knowledge. Some use the words gut feel, intuition, even divine inspiration. I prefer to use the term intuition, gut feel to me sounds like Im waiting for a disaster to happen and the term divine inspiration seems to suggest that the person who gets the knowledge can not be questioned because it is from God. I feel that all intuition must be taken with a grain of salt and validated before being taken seriously. Schizophrenics also receive messages by hearing voices in their heads, but they are not necessarily correct.
Different strokes for different folks. I feel that if one is enlightened, or simply deeply intuitive, he/she must be able to discern what is right or wrong because he/she has evolved to such a state that just thinking of doing something bad is disgusting to him/her. This person does things not out of faith, not out of fear from retribution of people, not out of fear of going to hell, but simply because he/she knows what is right and wrong. Other people though who are not yet in this state, have to be told what to do, what is right and wrong. If this is the case, then so be it, it is best that they behave out of faith than out of intuition.

We can now sense the possibility of being overtaken by events.

But reviewing missing billions and observing overnight successes is not a solution. Yet that is our lot. It is very doubtful that the masses in the industrialised countries would embrace Islam. But is that not increasingly appearing as a solution? The smut, corruption and spin is spilling over. Our personal freedoms are confined to deviance, decadence and consumer rights. All the while with increasing fear.
And our secret bands of doers act above the law, break the law and are a law unto themselves. In true Mob mentality an allegiance is called for. But what is it too? Now all eyes are on Jewish Power. And the agenda remains more wars. Requiring financing, all for a secret ideology. And the resources are a small part of the reasons for the wars.
We will surely collapse before achieving the gloated aims of control. But no one wants to change tack. Everyone is in a pyramid, compromising their beliefs.
Thinking of solutions is going out of fashion. But making peace with the enemies sounds like a certain winner.

Ehud Barak is called to leave the Labor party leadership after the poor results he achieved.
Israel's former Labor leader has threatened to oust his successor Ehud Barak, should he refuse to step down as the party's chairman.
Member of Knesset (Israeli parliament), Amir Peretz -- who led the Labor party during Israel's previous elections in 2006 -- said Defense Minister Ehud Barak needs to resign from his position as Labor chairman, following the party's poor performance in the elections.
"When I led the party in 2006, if I would have gotten 13 seats, I would have quit immediately," Peretz told The Jerusalem Post. [...]
"We need to take two steps: Set a timetable for choosing a chairman and form an interim leadership team to start the process of rehabilitating the party. Barak certainly cannot do that alone," he added.
Peretz concluded that Labor's institutions should be convened as soon as possible to decide that the party would not join any new government, even if it were led by Kadima.
